Covid-19 continues to take its toll on access to the courthouse. Courts have begun to have Zoom virtual hearings in non-emergency cases. This is determined on a case by case basis. Essentially, if there are numerous witnesses and the matter is urgent, (generally physical or mental safety of the parties or children) the Court will grant an in-person hearing.
The Courts are really starting to get back logged. Again, first and foremost I urge you to work with the other party as much as possible, and attend mediation promptly. The majority of cases, particularly on matters of temporary orders, are resolved in mediation.
When the Courts reopen again there will be a back log of cases, like releasing a dam that has been holding water. Waiting to begin any legal proceeding will further delay the flow of your case.
